Note 1: NOR same as DRY* / DRY = 8'6 & 9'6 / SPEC = Flat Rack and Open Top.

Note 2: Charges in USD per calendar day (including weekends and holidays) after free time expires.
Note 3: Terminal storage charges may apply, nevertheless, those are charged directly by Terminal Operator.
Note 4: Import Combined Demurrage and Detention | from discharge full at terminal to empty return in our depot.
Note 5: From Manaus we apply 15 DAYS free time.
Note 6: Container demurrage tariffs and conditions applicable for the port of discharge located in Brazil, including the free time, are registered in the Documents Registry Notary Office in the city of Santos, under number 732.745
Note 7: Note that the demurrage and detention conditions shall not apply if the booking/shipment was placed under Maersk Spot (instant rate/booking system) conditions which are available in the below downloadable document and which shall supersede any separately agreed terms. In case of doubts, please check with the Shipper or local agents the modality of booking/shipment that was hired.
Note 8: Maersk uses a Progressive method to calculate demurrage and detention charges upon expiry of the free-time, which means that for customers with special deals, after the extended free time expires, any additional days will be subject to the demurrage and detention charges as per the relevant day count in our tariff tier structure. This means that the subsequent demurrage and detention charges beyond extended free time will not automatically be calculated basing on the tariffs of 1st tier.
Note 9: Demurrage and Detention deals are based on the Price Calculation Date of your shipments.
Note 10: Shipper assumes before the shipowner the contractual and legal duty to export/ship their cargo to a Consignee who has real interest and conditions in acquiring/receiving the imported cargo, promoting its effective removal at the destination, with the fulfillment of all obligations inherent to this act. If the cargo is abandoned at its destination or if it is not removed by the Consignee for any reason, the Shipper will be jointly and severally liable, together with the Consignee, for all amounts, cost, expense, damage or loss that carrier may suffer as a result of this situation.

Manifest and CE useful information
Deadline determined by Brazilian's Government for launch Manifest is 48 hours before the ship docks at the first Brazilian port, however, we usually launch manifest and CE 5 working days before the ship docks at the first port.
Customs Amendment
- Out of deadline: Amendments after the deadline (48 hours before the ship docks at the first Brazilian port) are for that, consignee must provide LOI (responsibility for customs penalty of BRL 5000) + payment of AMF BRL 900. If the mentioned amendment is necessary, consignee needs to approach us at destination and then we will inform them the procedures needed.
- Within the legal deadline: Amendments request until 72 hours before the ship docks at the first Brazilian port, will be necessary to approve the cost of BRL 450,00 and return the set of BLs to our local office.

Siscarga Implementation
Siscarga is the new automated system for Brazilian Customs and its implementation has the objective of controlling the entrance and exit of vessels on bonded ports, foreign cargo for imports, exports or in transit and empty containers transported by sea, since its manifest up to its delivery to the importer or exit of bonded territory, as well as plan customs inspection prior to cargo arrival, through risk analysis over informed data.

IMO
Sticking to Brazil’s legislation (ANTAQ RES 2239 15/09/2011) that requires below listed documents for IMO Cargo, as from February 01st , 2016 Maersk will require below dangerous cargo documents at origin for all bookings with destination Brazil.
- Material Safety Data Sheet (MSDS)
- Multimodal Dangerous Goods Form (MDGF)
The content you provide will remain the same as today, you just need to populate in the attached form(Form to be filled).
Remarks (items B,C and D)
In case that customs’ deadline has expired, to amend Consignee,customer will be exposed to fine of BRL 5,000.
Fill the below form attached(Form to be filled) + BRL 700,00 (amendment cost)
MSDS form, will be required for all IMO bookings.
This requirement is in force by law and Maersk along with other carriers want to follow all legal requirements. Valid for all bookings requested as from February 1st, 2016. Dangerous cargo bookings without necessary documentation at origin will not be loaded.

Out-of-Gauge cargo (OOG) shipments
The lashing certificate is a mandatory document for the shipment of OOG units for bookings that have Brazil as transshipment port, place of receipt or place of delivery, as follows:
The lashing certificate document is mandatory for 20 FLAT and 40 FLAT containers that have Brazil as transshipment port, place of receipt or place of delivery. It is also mandatory for 20 OPEN TOP and 40 OPEN TOP containers that have the port of Manaus- Brazil as transshipment port, place of receipt or place of delivery.
In all cases, the lashing certificate must contain photos of the cargo.

BL Clause - Documentation: the manifests must state weight in kilos.
Received for Shipment is not accepted by any Brazilian port by the local authorities. Please do not use it.

NCM (harmonized cargo code): mandatory information in all import BLs. NCM number must be inserted on cargo description field.
- Consignee must be a Brazilian Company, with Tax ID (CNPJ), full address, telephone number and email address. We do not accept shipments with private persons (CPF) as part of the BL or transport contract (consignee/shipper/notify party)
- If the cnee is "To the order", First Notify information must be updated with a Brazilian company, including all details (address, phone, zip code, telephone number and e-mail address and Complete company name)
- If the cnee is "To Order of a Bank " or "In name of a Bank ", CNPJ of the bank will be required as Mandatory and also the First Notify information must be updated with a Brazilian company, including all details (address, phone, zip code,telephone number and e-mail address and Complete company name)
- If the Cnee is "To the order of a foreign Bank", the First Notify information must be updated with a Brazilian company, including all details (address, phone, zip code, telephone number and e-mail address and Complete company name)
- Foreign Consignee is not allowed
As per Merchant Marine law nr 10.833 the AFRMM (Merchant Marine Tax) is applied in the total amount of freight and charges incurred in the transport including port expenses declared in the transport document (including Terminal handling charge destination - CAPATAZIA). Original Bl without these information are not accepted by local authorities and consignee as well as carrier will face problems with authorities.
Date of issuance of the original BL: the same date must appear in the printed copy at final destination.
Freigh as per agreement: it is not acceptable.
Cargo House / Pier (CFS): it is not accepted.
Cargo from Uruguay or Argentina with final destination Brazil: It is a must to use the Mercosul Countries flag's BL. Maersk is no longer doing such kind of transport. Aliança is our Brazilian flag available for that.
Household Goods/Personal Effects: Maersk Brazil is not currently moving bookings for below types of cargo, for either natural person (CPF) or company entity (CNPJ):
- Household Goods
- Personal Effects
- Consolidated Cargo
- Diplomatic Cargo
- Furniture
Bookings submitted with this kind of commodity will be rejected.
Additionally, any kind of commodity/NCM amendment at later stage will be deemed as customer’s responsibility.
